Terms of Service

1. The service
Avelix is an upcoming application that calculates suggested buy prices for collectible trading cards, providing automated estimates and informational tools to help resellers decide what to pay. The service currently available at avelix.app is the Avelix pre-launch waitlist (the “Waitlist”). Joining the Waitlist reserves your place and, where offered, an early-signup rate applicable upon launch of the application. These Terms of Service (“Terms”) govern your use of the Waitlist. The Avelix Privacy Policy is incorporated into these Terms by reference. Avelix is operated by Avelix Technologies LLC (“Avelix Technologies” or “we”), a California limited liability company. In these Terms, “Avelix” refers to the application and service; “we,” “us,” and “our” refer to Avelix Technologies LLC.
2. Eligibility
You must be at least eighteen (18) years of age to join the Waitlist. By joining, you represent that you are eighteen or older, and that the email address you provide is yours and is accurate.
3. Payment
No payment is collected at signup. Joining the Waitlist is free of charge and creates no obligation to subscribe to the application upon launch.
4. Early-signup pricing
Where your signup includes an early-signup rate: (a) if the application launches, the rate will be honored for the subscription plan on which it was offered, should you elect to subscribe; (b) the rate is associated with the email address used at signup, applies only to your account, and is not transferable; (c) the rate may not be combined with other offers; (d) early-signup rates are limited in number and allocated in order of signup; (e) stated prices exclude applicable taxes; and (f) we reserve the right to revoke any early-signup rate obtained through misuse of the Waitlist, including automated, duplicate, or alias signups.
5. Acceptable use
You agree not to access or use the Waitlist by automated means; submit bulk, duplicate, or alias signups; scrape or harvest data from the Site; or otherwise interfere with the operation of the Site or the participation of others. We may remove any signup made in violation of these Terms.
6. Intellectual property
The Avelix name, the Site, and all content, designs, and materials displayed on the Site are owned by Avelix Technologies LLC. Nothing in these Terms grants you any right or license to such materials.
7. Changes to the service
The Avelix application is under active development. We may modify, suspend, or discontinue the application or the Waitlist, in whole or in part, at any time. Features, limits, pricing structures, and screenshots presented prior to launch describe current intentions only and are subject to change without notice.
8. Disclaimer of warranties
The Waitlist is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including any warranty regarding launch timing, availability, or the features of the eventual application. Any features, data models, or estimates displayed on the Site or via the Waitlist are provided “as is” for informational purposes only and do not constitute financial, investment, or purchasing advice. All purchasing, bidding, and selling decisions, and any resulting outcomes, are solely your responsibility.
9. Limitation of liability
To the maximum extent permitted by applicable law, Avelix Technologies LLC and the individuals operating it shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of profits or data, arising out of or relating to the Waitlist, any purchasing or bidding decisions, transaction outcomes, or financial losses incurred by you, any delay or failure of the application to launch, or any modification or discontinuation of the service. To the extent any liability is found notwithstanding the foregoing, the aggregate liability of Avelix Technologies LLC shall not exceed the greater of fifty U.S. dollars (US $50) or the amounts you have paid to Avelix.
10. Dispute resolution; governing law
Before initiating any formal proceeding, you agree to first contact support@avelix.app and allow a reasonable opportunity to resolve the matter informally. These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Waitlist shall be brought exclusively in the state or federal courts located in San Diego County, California.
11. Changes to these terms
We may revise these Terms from time to time. The effective date above will reflect the most recent revision, and material changes will be communicated by email where we hold a valid address. Continued participation in the Waitlist following the effective date of revised Terms constitutes acceptance of those Terms.
12. General
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Avelix Technologies LLC with respect to the Waitlist.
